By ordering or receiving a report for Employment Purposes, you certify the following:

1. You are the End-User and you will use the report as a "consumer report" and only for "employment purposes" under the FCRA. You will not use (or permit anyone else to use) information from the report in violation of any applicable federal or state equal employment opportunity law or regulation.
2. You have given the subject clear, conspicuous, written disclosure (in a document consisting solely of the disclosure) that a consumer report may be obtained for employment purposes and that each of the disclosures were not combined with anything else.
3. You have obtained the subject's prior written authorization to procure this report.
4. You have provided any additional disclosures and authorizations required by STATE law.
5. Before taking adverse action, you agree to provide the subject with the Summary of Rights and a copy of the report you received.
6. You will not take any adverse action based on information in the report UNLESS: You have given the subject a reasonable period after providing the notice of at least 5 business days in which to dispute or explain the information.
7. When you take adverse action based on information in the report, you agree to give the subject written notice: (1) of the adverse action being taken; (2) The reason for the adverse action; (3) of the name, mailing address, telephone number, and website address of References-Etc; (4) A statement that References-Etc did not make the adverse decision nor we are able to explain why the decision was made; (5) that the subject can obtain a free copy of the report by requesting one within 60 days; and (6) that the subject may dispute the accuracy or completeness of any information provided.
8. If the FCRA governs the report or information from it as an investigative consumer report, the End-User has given the subject: (1) a clear and accurate disclosure that an investigative consumer report including information on the subject's character, general reputation, personal characteristics, and mode of living, whichever are applicable, may be made; (2) a statement that the subject has the right to obtain a complete and accurate disclosure of the scope and nature of the investigation performed; and (3) Provided the subject with a Summary of Your Rights . If the subject requests, the End-User will make a complete and accurate disclosure of the nature and scope of the investigation and deliver that disclosure to the subject within five days.
9. You confirm that you have independently educated yourself about your duties and legal responsibilities under applicable law. You confirm that you are not relying on us to ensure that you are complying with applicable law.
10. You, the End-User, agree to keep all supporting documentation and consent forms that support your permissible purpose for procuring this report for a period of no less then 5 years. References-Etc randomly audits orders to ensure compliance and verify new accounts. You agree to provide all supporting documents within 5 business days of receiving notice from us.
11. You confirm you understand when you're done using a consumer report, you must securely dispose of the report and any information you gathered from it so that it can't be read or reconstructed.
12. By accepting the terms below, you intend your agreement to serve as your electronic signature.

By ordering or receiving a report for Insurance Purposes, you certify the following:

1. You are the End-User and you will use the information in the report only as a "consumer report" under the FCRA for determining the subject's eligibility for insurance or the rate for insurance.
2. If the report is an investigative consumer report under the FCRA, you have given the subject: (1) a clear and accurate disclosure that an investigative consumer report including information on the subject's character, general reputation, personal characteristics, and mode of living, whichever are applicable, may be made; (2) a statement that the subject has the right to obtain a complete and accurate disclosure of the scope and nature of the investigation performed; and (3) the Consumer Financial Protection Bureau's "a Summary of Your Rights under the Fair Credit Reporting Act". If the subject requests, you the End-User, will make a complete and accurate disclosure of the nature and scope of the investigation and deliver that disclosure to the subject within five days.
3. You have provided any additional disclosures and authorizations required by STATE law.

When you take adverse action based on information in the report, you agree to give the subject written notice: (1) of the adverse action being taken; (2) The reason for the adverse action; (3) of the name, mailing address, telephone number, and website address of References-Etc; (4) A statement that References-Etc did not make the adverse decision nor we are able to explain why the decision was made; (5) that the subject can obtain a free copy of a report by requesting one within 60 days; and (6) that the subject may dispute the accuracy or completeness of any information provided.

You are the End-User and you will use information in the report only as a "consumer report" under the FCRA and only for a legitimate business purpose that is in connection with a business transaction initiated by the subject or to review an account to determine whether the consumer continues to meet the terms of the account.
2. You will not use the report for any other purpose defined by the FCRA Section 604, such as the evaluation of employment, credit, insurance etc...
3. If the FCRA governs the report or information from it as an investigative consumer report, you have given the subject: (1) a clear and accurate disclosure that an investigative consumer report including information on the subject's character, general reputation, personal characteristics, and mode of living, whichever are applicable, may be made; (2) a statement that the subject has the right to obtain a complete and accurate disclosure of the scope and nature of the investigation performed; and (3) Provided the subject with a Summary of Your Rights.
